Terms of Service

Welcome to Mocka ("Mocka", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Mocka regarding your access to and use of our suite of digital products, including:

• MockaScreen for macOS: Native macOS desktop screen recording, ScreenCaptureKit system audio capture, microphone pass-through, Vision AI webcam overlay, and local Metal render software.
• MockaEditor: Web-based and native canvas application for beautifying screenshots, adding 3D device mockups, backgrounds, annotations, and graphic exports.
• Mocka Cloud & Stream: Cloud storage, instant link sharing, HLS video player hosting, password protection, and viewing analytics.
• Mocka Websites & APIs: mocka.app, mocka.studio, and associated endpoints.

By downloading, installing, accessing, or using any part of the Mocka ecosystem, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

To access certain features (such as subscription management, cloud sharing, and license activation), you must create an account.

You agree to provide accurate, current, and complete information during registration and promptly update your email if it changes. You may not share your account or license seat with unauthorized third parties.

Mocka provides both free and paid subscription plans. Current features and pricing are clearly detailed on our Pricing Page.

• Payment Processors: We partner with trusted, PCI-DSS Level 1 compliant Merchant of Record and payment gateways (including Polar.sh and Stripe) to securely process card payments, Apple Pay, and Google Pay. Mocka does not store your full credit card number.
• Automatic Renewal: Subscription fees are billed on the recurring date specified at checkout. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.
• Cancellation: You can cancel your subscription at any time via your Account Dashboard or by emailing team@mocka.studio. Upon cancellation, you will retain full Pro access until the conclusion of your current paid billing period.

We want you to love using Mocka. If you purchase a Mocka Pro subscription and find that it does not meet your expectations, we offer a 14-day 100% money-back refund guarantee from the date of your initial purchase.

* Note: Subsequent renewal periods after the initial 14-day guarantee are non-refundable, but you may cancel anytime to prevent future renewals.

Subject to your compliance with these Terms and active subscription tier, Mocka grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and execute the MockaScreen desktop application and access MockaEditor.

At Mocka, our philosophy is Creator First. We respect your intellectual property:

• Your Content Belongs to You: You retain complete, unencumbered intellectual property rights and copyright to all video captures, audio recordings, screen grabs, canvas designs, and media generated through Mocka.
• Zero Training on User Data: Mocka does not use your private screen recordings, uploaded videos, or screenshots to train AI or machine learning models without your explicit, voluntary written consent.
• Cloud Hosting License: Solely for the technical purpose of hosting, transcoding (e.g. HLS streaming), and displaying your videos when you explicitly select "Share Link", you grant Mocka a limited, worldwide, non-exclusive license to store and transmit that specific file on our cloud infrastructure.

To showcase real-world adoption of Mocka by creators, software engineering teams, product designers, and media organizations:

• Customer Reference & Logo Permission: If you register for an account using a business, institutional, or corporate email domain (or otherwise use Mocka on behalf of a company, organization, or commercial entity), you grant Mocka a non-exclusive, worldwide, royalty-free license to display your entity's name, trade name, and logo in customer showcases, on our website, and in promotional materials solely to identify your organization as a user of Mocka (for example, "Used by teams and creators at [Company]").
• No Implied Endorsement: Mocka will not state or imply that your organization officially sponsors or endorses our software without a separate written agreement.
• Simple Opt-Out Process: You or your organization may revoke this logo and reference authorization at any time by sending an email with your organization's domain to support@mocka.studio. Upon receipt, Mocka will remove your entity's name and logo from active digital marketing materials within five (5) business days.

You agree not to use Mocka for any unlawful, harassing, infringing, or malicious purposes. Specifically, you agree not to:

• Record, distribute, or stream content that violates copyright, trademark, trade secret, or other proprietary rights of third parties.
• Record individuals without proper consent in violation of applicable wiretapping, eavesdropping, or surveillance privacy statutes.
• Upload or share content containing malware, viruses, phishing lures, or non-consensual explicit material.
• Decompile, disassemble, reverse engineer, or attempt to derive the source code of the Mocka desktop clients or cloud backend.
• Bypass, circumvent, or tamper with license authentication checks, usage quotas, or cloud access controls.

Mocka reserves the right to suspend or terminate access to cloud sharing services for accounts that violate this Acceptable Use Policy.

When you publish a video or capture to Mocka Cloud:

We strive to maintain high availability and redundancy. However, Mocka Cloud is intended as a sharing and collaboration platform, not an archival cold storage backup. Users are encouraged to maintain local copies of critical video recordings.

Local-First Architecture: Unlike browser-dependent recording tools that fail during network dropouts, the MockaScreen desktop application captures, mixes audio, and renders video directly on your local hardware (GPU/CPU). No internet connection is required to record or export high-resolution media locally.

For online cloud features (including authentication, instant link sharing, and web editor), we target a 99.9% uptime availability benchmark, excluding scheduled maintenance windows announced in advance.

You may terminate your agreement with Mocka at any time by requesting account deletion through your dashboard or by emailing privacy@mocka.studio.

Upon receipt of a verified deletion request:

• Your account profile and authentication records will be deactivated immediately.
• All cloud-hosted videos, shared links, and thumbnails will be permanently wiped from our edge storage within 48 hours.
• Any active subscriptions will be cancelled with no further billing cycles.

Important Legal Disclaimer:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MOCKA SOFTWARE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

IN NO EVENT SHALL MOCKA, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA LOSS, OR SYSTEM INTERRUPTION) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES.

IN ALL CASES, MOCKA'S TOTAL AGGREGATE LIABILITY UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES PAID BY YOU TO MOCKA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00 USD).

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

Informal Resolution First: Before initiating any formal legal dispute or arbitration, you agree to contact us at legal@mocka.studio with a brief description of the issue. Both parties agree to engage in good-faith negotiations for at least 30 days to resolve the matter amicably.

We may revise these Terms from time to time to reflect improvements to our software, changes in legislation, or standard industry practices. When changes occur, we will update the "Last Modified" date at the top of this document.

For material changes that significantly affect your rights, we will provide prominent advance notice (such as an email notification or an announcement in the desktop app) prior to the new terms taking effect. Continued use of Mocka after updates constitute acceptance of the revised Terms.
